EL CENTRO — Edgard Garcia was present at Imperial County Superior Court during a pretrial and setting of jury trial for an alleged DUI incident that reportedly occurred earlier this year where the mayor was charged with two counts of violating vehicle code section 23152(a)/(b).

During the hearing, Garcia’s defense attorney, Jason Amavisca, requested a continuance for discovery. The prosecution, represented by Deputy Attorney General Adrian Contreras, had no objection to rescheduling for a later date.

Due to Civil Procedure Code 170.1 which allows judges to disqualify themselves from cases for reasons which may disallow a fair and unbiased judgment, the Honorable Judge Donal Donnelly was summoned after four judges had recused themselves from the case June 18.

At the hearing, Judge Donnelly did not mention any caveats about potentially recusing himself from the case.

As it stands, Judge Donnelly is scheduled to preside over the pretrial and trial setting slated for 8:30 a.m. September 25 at the Imperial County Superior Court in El Centro.
